General conditions of sale

  1. Payment terms: cash unless otherwise agreed.

  2. Sizes and quantities: after allocation, ARTIMAR reserves the right to check sizes and quantities on site. The customer will accept any resulting corrections in more. If the deviation exceeds 5%, ARTIMAR reserves the right to cancel the order or offer different prices.

  3. Price adjustments: ARTIMAR reserves the right to increase its prices if the execution of the order is delayed for reasons beyond its control by at least 3 months or if the cost price of the products to be delivered increases by at least 3% between order and delivery.

  4. Cancellation of an order entitles ARTIMAR to opt for a lump sum compensation for loss of profit of.20% with a minimum of 500 € and this apart from the compulsory purchase after payment of ordered and customized goods.

  5. Non-payment: In case of non-payment, default interest equal to 10%/per year + a fixed compensation of 10% on the late payment is due by right. In case of non-payment, ARTIMAR also has the right, after notice, to suspend its performance. If this suspension lasts longer than 14 days or is repeated, ARTIMAR has the right to terminate the contract early at the expense of the customer and to claim damages pursuant to Article 4. ARTIMAR then also has the right to claim claims that are not yet due.

  6. Delivery times are indicative and never binding.

  7. Visible defects must be reported upon delivery. Invisible defects must be reported within 48 hours of their discovery. Both under penalty of forfeiture of any right. Even done so timely, they in no way give the customer the right to defer or suspend his payment obligation. The customer is obliged to check delivered goods before placement/processing. Having material placed/processed unconditionally implies an explicit acceptance of the delivered product.

  8. The liability of ARTIMAR is conventionally limited to the return or replacement of defective products. ARTIMAR is not responsible for deviations due to the nature of the products ordered (e.g. inherent to natural stone).By placing the order, the customer confirms having been informed in detail about the technical characteristics of the products ordered, the maintenance prescriptions to be respected afterwards as well as the prices and conditions applied.

  10. ARTIMAR does not accept any purchase conditions from its customers under any form. Only what is stated in its offers or is part of them binds it.

  11. If goods are to be delivered and placed by ARTIMAR, the client will ensure that the spaces where the installation should take place are accessible on the agreed dates, that electricity and water are available and that the surroundings are secured and protected against possible nuisance or damage.

  12. Each time a delivery or installation is carried out, the client shall ensure that someone is present to inspect the delivery and/or the work carried out and to sign any delivery notes or work slips, failing which he/she shall be deemed to have assumed that everything was in order and that the delivery/executed work is accepted.

  13. In case of dispute, the courts of Antwerp, Tongeren department, are competent to judge according to Belgian law.

Special conditions

  1. If a quote or order states a stone type but no above finish, we will initially assume you mean the stone we have in our permanent stock.If the stone type is not included in our permanent stock, we then assume that you mean the shiny/poli variety. Exceptionally, with bluestone we assume that you mean the dark sweetened variety.

    1. The following are also assumed as standard, in the absence of mention:

      • shiny finishes for shiny stones

      • matt finishes for matt, burnt and/or brushed stones

      • the standard edge finish is straight finish.

  2. The minimum size of 0.10m² is used when calculating prices, for finishes such as polishing 2nd side and others there is a minimum of 1m²- this is also clearly indicated in the price list finishes.

  3. Cut-outs in composite and ceramic are not reinforced with glued-in reinforcement slats. For all other types of stone, reinforcement slats are not glued in; this is only done on special request and only for granite and marble. The minimum thickness for gluing in such slats is 30 mm. The distance between 2 recesses (sinks, hotplates, sockets, etc.) or the edge of a workpiece must always be at least 50 mm. If this standard is ignored, it is always at your own risk.

  4. In the case of a mitre board, a composite lath or alu is always added for reinforcement. If this is not desired, this must be clearly stated when ordering. Likewise, the normal miter finish is with a bevel, if a small rounding is desired, this must also be notified in advance. The price for both finishes is the same.

  5. A reduced plate rate is used for stock stones. This makes it possible for a vendor to work out the minimum number of slabs required for the current project and to calculate the price quote to the customer correctly. Applying a plate rate does not imply that the customer takes ownership of the plate or any remnants of the plate. Indicated sheet sizes in the rate is a gross sheet size. Net obtainable length and width may be several inches smaller.

  6. If the customer wishes to determine the cut layout himself (open book or stone with special drawing), this must be communicated in writing at the time of the order and an additional cost will be charged (see tariff p 89). This cost covers an increased administrative cost, higher plate loss, higher risk and greater difficulty in cutting.

  7. The normal delivery and production time varies between 10 and 20 working days, depending on the degree of difficulty, size, .... (This can increase several weeks before and after each construction holiday). This deadline is a target, not a commitment. Force majeure (illness, breakdown, stock breakage, etc.) can also cause the standard deadlines to be extended and cannot be used to claim any compensation.

  8. If a special order of stock alien stones is made, before accepting the order, a deposit of 50% of the total amount of the order may be requested. The delivery time for orders in stock foreign stones depends on the availability and deliverability of the material. Herein, we cannot always guarantee the normal delivery time.

  9. If you have a very urgent order (= rush order), we will assess the possibility of execution within the set deadline on a situation-by-situation basis. If we have not received the final measurements before 9 a.m. on a working day, this period will only start from the next working day. If we have to take measurements, the deadline also only starts from the next working day.

  10. Differences in thickness are unavoidable, a tolerance of 2mm is generally accepted.

  11. For composites with mirror particles, it may happen that these particles come loose. This is own the stone type and does not affect the quality of the stone.

  12. Plate dimensions, structure and color variations are variable and therefore unavoidable. Complaints about these are not acceptable afterwards. All stones are sold with their natural defects. Origin, color and texture are determined by the samples shown, which are only an indication of the final delivery and therefore, due to the natural nature, may not be identical.

  13. Some flatware must be milled out to a depth that compromises the strength of the worktop. In a worktop thickness of less than 30mm it is often not possible and we do not recommend the incorporation of such devices.

  14. All matt, burnt and/or brushed stone types are more difficult to maintain due to their finish: please pay attention to this and inform your customer. For a well-maintained granite or composite worktop, we always recommend the shiny finish.The all-white and all-black composite stones (almost without speckles) require more intensive maintenance even with the shiny finish.With shy areas in any stone, this principle is the same: due to the reworking, they are more difficult to maintain, regardless of the stone type.

  15. A worktop thickness of 20mm is usually sufficient with composite and Ceramic. For natural stone, we recommend a worktop thickness of 30mm. Thinner worktop thicknesses are available upon request, but due to their higher degree of fragility, we (and most suppliers) do not recommend this thickness as a worktop and decline all responsibility in the event of any damage.

  16. Even though granite, composite and ceramic are very strong and impact resistant, countertops that are not fully supported are at greater risk of fracture (over time) due to built-up stress. Please always provide optimal support so that this risk can be avoided. In case of impact (heat, force, point load) there is always a risk that the stone will be damaged.Due to its very high hardness, ceramic is more sensitive to impact damage (e.g. by bumping into (the edge of) the stone with objects or dropping onto it, etc.).

  17. We can advise you on feasibility/safety/stability/bearing capacity of the worktops in your design, but our advice is not binding.The final responsibility lies 100% with the designer / client.Always ensure that the stone can be fully supported to_go for maximum safety.

  18. Glued sinks are beautiful and very modern, but here too the rules of impact apply: direct contact with heat can cause the sink to crack. To counteract this effect, we recommend running cold water when slowly pouring hot cooking water.

  19. When making a reduced verlek area (or depth operations in general), the underlying structure of the stone becomes visible; these may differ from the top finish in color, texture and polish which is unavoidable and cannot be a cause for complaint.

  20. At the time of measurement, all preparatory work must be complete and final. The appliances must be visibly present on site and will be checked (if possible) for brand and type, usually without opening the box.For this, the kitchen supplier must provide us with the appropriate technical sheet. In the case of a shower, it must be possible, when installing the shower plate, ...it must be possible to provide a certain degree of slope.The foundation and pipes for water drainage should be done by a competent plumber.

Measurements, deliveries and installations

No discounts are given on the prices for measurements, deliveries and installations.Joints are provisionally fixed during the measurement according to our own discretion and the possibility (size of plates, accessibility to site,...).The final joint layout will be done after the measurement is processed based on current inventory. Reconnecting appliances with gas is prohibited for us and therefore not included in the price or service.We reconnect appliances ready for use only if they were connected ready for use and no adjustments need to be made to the cabinets, pipes, height, ...

Warranty conditions:

Artimar nv guarantees the sound execution of the work and the quality of the delivered goods under the same conditions as the original manufacturer.If the latter has no specific conditions, only the legal warranty rules apply.The buyer will not be able to invoke the warranty if the defect is the result of a manipulation error or faulty maintenance by the buyer himself.

If Artimar nv does not perform the installation of the material itself, it will not be able to be held liable for an unsuitable choice of the buyer, nor for the burden or inconveniences that may arise during, or after the use of the delivered and accepted goods

If Artimar nv is held liable based on one of the above cases, the damage will be repaired in kind where possible. Artimar nv is only bound to replace the damaged part to the exclusion of any reason whatsoever. The customer-purchaser accepts without any reservation that these repair works do not give rise to any reduction in value of the natural stone, as this value was agreed in the quotation or order form.Only direct damage is eligible for repair or compensation.Consequential damage to other parts, such as painting, as a result of the (partial) repair shall remain the responsibility of the buyer who cannot hold the seller / placer liable for this.

The buyer declares to be aware of the properties of the delivered goods.The buyer will not be able to hold Artimar nv liable for any differences in color that a possible partial repair may cause due to, for example, fatigue of the part not replaced or the fact that the originally delivered stone is no longer in stock.The suppliers' warranty is limited to the material itself and never includes the cost of reworking and reinstalling the material.
